  3. The Educational Community License version 2.0 ("ECL") consists of the Apache
  4. 2.0 license, modified to change the scope of the patent grant in section 3
  5. to be specific to the needs of the education communities using this license.
  6. The original Apache 2.0 license can be found at: http://www.apache.org/licenses/LICENSE-2.0
  7. TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION
  8. 1. Definitions.
  9. "License" shall mean the terms and conditions for use, reproduction, and distribution
  10. as defined by Sections 1 through 9 of this document.
  11. "Licensor" shall mean the copyright owner or entity authorized by the copyright
  12. owner that is granting the License.
  13. "Legal Entity" shall mean the union of the acting entity and all other entities
  14. that control, are controlled by, or are under common control with that entity.
  15. For the purposes of this definition, "control" means (i) the power, direct
  16. or indirect, to cause the direction or management of such entity, whether
  17. by contract or otherwise, or (ii) ownership of fifty percent (50%) or more
  18. of the outstanding shares, or (iii) beneficial ownership of such entity.
  19. "You" (or "Your") shall mean an individual or Legal Entity exercising permissions
  20. granted by this License.
  21. "Source" form shall mean the preferred form for making modifications, including
  22. but not limited to software source code, documentation source, and configuration
  23. files.
  24. "Object" form shall mean any form resulting from mechanical transformation
  25. or translation of a Source form, including but not limited to compiled object
  26. code, generated documentation, and conversions to other media types.
  27. "Work" shall mean the work of authorship, whether in Source or Object form,
  28. made available under the License, as indicated by a copyright notice that
  29. is included in or attached to the work (an example is provided in the Appendix
  30. below).
  31. "Derivative Works" shall mean any work, whether in Source or Object form,
  32. that is based on (or derived from) the Work and for which the editorial revisions,
  33. annotations, elaborations, or other modifications represent, as a whole, an
  34. original work of authorship. For the purposes of this License, Derivative
  35. Works shall not include works that remain separable from, or merely link (or
  36. bind by name) to the interfaces of, the Work and Derivative Works thereof.
  37. "Contribution" shall mean any work of authorship, including the original version
  38. of the Work and any modifications or additions to that Work or Derivative
  39. Works thereof, that is intentionally submitted to Licensor for inclusion in
  40. the Work by the copyright owner or by an individual or Legal Entity authorized
  41. to submit on behalf of the copyright owner. For the purposes of this definition,
  42. "submitted" means any form of electronic, verbal, or written communication
  43. sent to the Licensor or its representatives, including but not limited to
  44. communication on electronic mailing lists, source code control systems, and
  45. issue tracking systems that are managed by, or on behalf of, the Licensor
  46. for the purpose of discussing and improving the Work, but excluding communication
  47. that is conspicuously marked or otherwise designated in writing by the copyright
  48. owner as "Not a Contribution."
  49. "Contributor" shall mean Licensor and any individual or Legal Entity on behalf
  50. of whom a Contribution has been received by Licensor and subsequently incorporated
  51. within the Work.
  52. 2. Grant of Copyright License.
  53. Subject to the terms and conditions of this License, each Contributor hereby
  54. grants to You a perpetual, worldwide, non-exclusive, no-charge, royalty-free,
  55. irrevocable copyright license to reproduce, prepare Derivative Works of, publicly
  56. display, publicly perform, sublicense, and distribute the Work and such Derivative
  57. Works in Source or Object form.
  58. 3. Grant of Patent License.
  59. Subject to the terms and conditions of this License, each Contributor hereby
  60. grants to You a perpetual, worldwide, non-exclusive, no-charge, royalty-free,
  61. irrevocable (except as stated in this section) patent license to make, have
  62. made, use, offer to sell, sell, import, and otherwise transfer the Work, where
  63. such license applies only to those patent claims licensable by such Contributor
  64. that are necessarily infringed by their Contribution(s) alone or by combination
  65. of their Contribution(s) with the Work to which such Contribution(s) was submitted.
  66. If You institute patent litigation against any entity (including a cross-claim
  67. or counterclaim in a lawsuit) alleging that the Work or a Contribution incorporated
  68. within the Work constitutes direct or contributory patent infringement, then
  69. any patent licenses granted to You under this License for that Work shall
  70. terminate as of the date such litigation is filed. Any patent license granted
  71. hereby with respect to contributions by an individual employed by an institution
  72. or organization is limited to patent claims where the individual that is the
  73. author of the Work is also the inventor of the patent claims licensed, and
  74. where the organization or institution has the right to grant such license
  75. under applicable grant and research funding agreements. No other express or
  76. implied licenses are granted.
  77. 4. Redistribution.
  78. You may reproduce and distribute copies of the Work or Derivative Works thereof
  79. in any medium, with or without modifications, and in Source or Object form,
  80. provided that You meet the following conditions:
  81. a. You must give any other recipients of the Work or Derivative Works a copy
  82. of this License; and
  83. b. You must cause any modified files to carry prominent notices stating that
  84. You changed the files; and
  85. c. You must retain, in the Source form of any Derivative Works that You distribute,
  86. all copyright, patent, trademark, and attribution notices from the Source
  87. form of the Work, excluding those notices that do not pertain to any part
  88. of the Derivative Works; and
  89. d. If the Work includes a "NOTICE" text file as part of its distribution,
  90. then any Derivative Works that You distribute must include a readable copy
  91. of the attribution notices contained within such NOTICE file, excluding those
  92. notices that do not pertain to any part of the Derivative Works, in at least
  93. one of the following places: within a NOTICE text file distributed as part
  94. of the Derivative Works; within the Source form or documentation, if provided
  95. along with the Derivative Works; or, within a display generated by the Derivative
  96. Works, if and wherever such third-party notices normally appear. The contents
  97. of the NOTICE file are for informational purposes only and do not modify the
  98. License. You may add Your own attribution notices within Derivative Works
  99. that You distribute, alongside or as an addendum to the NOTICE text from the
  100. Work, provided that such additional attribution notices cannot be construed
  101. as modifying the License.
  102. You may add Your own copyright statement to Your modifications and may provide
  103. additional or different license terms and conditions for use, reproduction,
  104. or distribution of Your modifications, or for any such Derivative Works as
  105. a whole, provided Your use, reproduction, and distribution of the Work otherwise
  106. complies with the conditions stated in this License.
  107. 5. Submission of Contributions.
  108. Unless You explicitly state otherwise, any Contribution intentionally submitted
  109. for inclusion in the Work by You to the Licensor shall be under the terms
  110. and conditions of this License, without any additional terms or conditions.
  111. Notwithstanding the above, nothing herein shall supersede or modify the terms
  112. of any separate license agreement you may have executed with Licensor regarding
  113. such Contributions.
  114. 6. Trademarks.
  115. This License does not grant permission to use the trade names, trademarks,
  116. service marks, or product names of the Licensor, except as required for reasonable
  117. and customary use in describing the origin of the Work and reproducing the
  118. content of the NOTICE file.
  119. 7. Disclaimer of Warranty.
  120. Unless required by applicable law or agreed to in writing, Licensor provides
  121. the Work (and each Contributor provides its Contributions) on an "AS IS" BASIS,
  122. WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including,
  123. without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT,
  124. MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible
  125. for determining the appropriateness of using or redistributing the Work and
  126. assume any risks associated with Your exercise of permissions under this License.
  127. 8. Limitation of Liability.
  128. In no event and under no legal theory, whether in tort (including negligence),
  129. contract, or otherwise, unless required by applicable law (such as deliberate
  130. and grossly negligent acts) or agreed to in writing, shall any Contributor
  131. be liable to You for damages, including any direct, indirect, special, incidental,
  132. or consequential damages of any character arising as a result of this License
  133. or out of the use or inability to use the Work (including but not limited
  134. to damages for loss of goodwill, work stoppage, computer failure or malfunction,
  135. or any and all other commercial damages or losses), even if such Contributor
  136. has been advised of the possibility of such damages.
  137. 9. Accepting Warranty or Additional Liability.
  138. While redistributing the Work or Derivative Works thereof, You may choose
  139. to offer, and charge a fee for, acceptance of support, warranty, indemnity,
  140. or other liability obligations and/or rights consistent with this License.
  141. However, in accepting such obligations, You may act only on Your own behalf
  142. and on Your sole responsibility, not on behalf of any other Contributor, and
  143. only if You agree to indemnify, defend, and hold each Contributor harmless
  144. for any liability incurred by, or claims asserted against, such Contributor
  145. by reason of your accepting any such warranty or additional liability. END
  146. OF TERMS AND CONDITIONS
