  8. <h3>Usage Of Content</h3>
  9. <p>THE ECLIPSE FOUNDATION MAKES AVAILABLE SOFTWARE, DOCUMENTATION,
  10. INFORMATION AND/OR OTHER MATERIALS FOR OPEN SOURCE PROJECTS
  11. (COLLECTIVELY "CONTENT"). USE OF THE CONTENT IS GOVERNED BY THE
  12. TERMS AND CONDITIONS OF THIS AGREEMENT AND/OR THE TERMS AND
  13. CONDITIONS OF LICENSE AGREEMENTS OR NOTICES INDICATED OR REFERENCED
  14. BELOW. BY USING THE CONTENT, YOU AGREE THAT YOUR USE
  15. OF THE CONTENT IS GOVERNED BY THIS AGREEMENT AND/OR THE TERMS AND
  16. CONDITIONS OF ANY APPLICABLE LICENSE AGREEMENTS OR

  21. <h3>Applicable Licenses</h3>
  22. <p>Unless otherwise indicated, all Content made available by the Eclipse
  23. Foundation is provided to you under the terms and conditions of the
  24. Eclipse Public License Version 1.0
  25. ("EPL"). A copy of the EPL is provided with this Content and is also
  26. available at <a href="http://www.eclipse.org/legal/epl-v10.html">http://www.eclipse.org/legal/epl-v10.html</a>.
  27. For purposes of the EPL, "Program" will mean the Content.</p>
  28. <p>Content includes, but is not limited to, source code, object code,
  29. documentation and other files maintained in the Eclipse Foundation
  30. source code
  31. repository ("Repository") in software modules ("Modules") and made
  32. available as downloadable archives ("Downloads").</p>
  33. <ul>
  34. <li>Content may be structured and packaged into modules to
  35. facilitate delivering, extending, and upgrading the Content. Typical
  36. modules may include plug-ins ("Plug-ins"), plug-in fragments
  37. ("Fragments"), and features ("Features").</li>
  38. <li>Each Plug-in or Fragment may be packaged as a sub-directory
  39. or JAR (Java&#8482; ARchive) in a directory named "plugins".</li>
  40. <li>A Feature is a bundle of one or more Plug-ins and/or
  41. Fragments and associated material. Each Feature may be packaged as a
  42. sub-directory in a directory named "features". Within a Feature, files
  43. named "feature.xml" may contain a list of the names and version numbers
  44. of the Plug-ins
  45. and/or Fragments associated with that Feature.</li>
  46. <li>Features may also include other Features ("Included
  47. Features"). Within a Feature, files named "feature.xml" may contain a
  48. list of the names and version numbers of Included Features.</li>
  49. </ul>
  50. <p>The terms and conditions governing Plug-ins and Fragments should be
  51. contained in files named "about.html" ("Abouts"). The terms and
  52. conditions governing Features and
  53. Included Features should be contained in files named "license.html"
  54. ("Feature Licenses"). Abouts and Feature Licenses may be located in any
  55. directory of a Download or Module
  56. including, but not limited to the following locations:</p>
  57. <ul>
  58. <li>The top-level (root) directory</li>
  59. <li>Plug-in and Fragment directories</li>
  60. <li>Inside Plug-ins and Fragments packaged as JARs</li>
  61. <li>Sub-directories of the directory named "src" of certain
  62. Plug-ins</li>
  63. <li>Feature directories</li>
  64. </ul>
  65. <p>Note: if a Feature made available by the Eclipse Foundation is
  66. installed using the Provisioning Technology (as defined below), you must
  67. agree to a license ("Feature Update License") during the
  68. installation process. If the Feature contains Included Features, the
  69. Feature Update License should either provide you with the terms and
  70. conditions governing the Included Features or
  71. inform you where you can locate them. Feature Update Licenses may be
  72. found in the "license" property of files named "feature.properties"
  73. found within a Feature.
  74. Such Abouts, Feature Licenses, and Feature Update Licenses contain the
  75. terms and conditions (or references to such terms and conditions) that
  76. govern your use of the associated Content in
  77. that directory.</p>
  78. <p>THE ABOUTS, FEATURE LICENSES, AND FEATURE UPDATE LICENSES MAY REFER
  79. TO THE EPL OR OTHER LICENSE AGREEMENTS, NOTICES OR TERMS AND CONDITIONS.

  94. <p>IT IS YOUR OBLIGATION TO READ AND ACCEPT ALL SUCH TERMS AND
  95. CONDITIONS PRIOR TO USE OF THE CONTENT. If no About, Feature License,
  96. or Feature Update License is provided, please
  97. contact the Eclipse Foundation to determine what terms and conditions
  98. govern that particular Content.</p>
  99. <h3>Use of Provisioning Technology</h3>
  100. <p>The Eclipse Foundation makes available provisioning software,
  101. examples of which include, but are not limited to, p2 and the Eclipse
  102. Update Manager ("Provisioning Technology") for the purpose of
  103. allowing users to install software, documentation, information and/or
  104. other materials (collectively "Installable Software"). This
  105. capability is provided with the intent of allowing such users to
  106. install, extend and update Eclipse-based products. Information about
  107. packaging Installable Software is available at <a
  108. href="http://eclipse.org/equinox/p2/repository_packaging.html">http://eclipse.org/equinox/p2/repository_packaging.html</a>
  109. ("Specification").</p>
  110. <p>You may use Provisioning Technology to allow other parties to install
  111. Installable Software. You shall be responsible for enabling the
  112. applicable license agreements relating to the Installable Software to
  113. be presented to, and accepted by, the users of the Provisioning
  114. Technology
  115. in accordance with the Specification. By using Provisioning
  116. Technology in such a manner and making it available in accordance with
  117. the
  118. Specification, you further acknowledge your agreement to, and the
  119. acquisition of all necessary rights to permit the following:</p>
  120. <ol>
  121. <li>A series of actions may occur ("Provisioning Process") in
  122. which a user may execute the Provisioning Technology
  123. on a machine ("Target Machine") with the intent of installing,
  124. extending or updating the functionality of an Eclipse-based
  125. product.</li>
  126. <li>During the Provisioning Process, the Provisioning Technology
  127. may cause third party Installable Software or a portion thereof to be
  128. accessed and copied to the Target Machine.</li>
  129. <li>Pursuant to the Specification, you will provide to the user
  130. the terms and conditions that govern the use of the Installable
  131. Software ("Installable Software Agreement") and such Installable
  132. Software Agreement shall be accessed from the Target
  133. Machine in accordance with the Specification. Such Installable
  134. Software Agreement must inform the user of the terms and conditions that
  135. govern
  136. the Installable Software and must solicit acceptance by the end
  137. user in the manner prescribed in such Installable Software Agreement.
  138. Upon such
  139. indication of agreement by the user, the provisioning Technology
  140. will complete installation of the Installable Software.</li>
  141. </ol>
  142. <h3>Cryptography</h3>
  143. <p>Content may contain encryption software. The country in which you are
  144. currently may have restrictions on the import, possession, and use,
  145. and/or re-export to
  146. another country, of encryption software. BEFORE using any encryption
  147. software, please check the country's laws, regulations and policies
  148. concerning the import,
  149. possession, or use, and re-export of encryption software, to see if
  150. this is permitted.</p>
