  14. <p>THE ECLIPSE FOUNDATION MAKES AVAILABLE SOFTWARE, DOCUMENTATION, 

  15. INFORMATION AND/OR OTHER MATERIALS FOR OPEN SOURCE PROJECTS

  16.    (COLLECTIVELY "CONTENT").  USE OF THE CONTENT IS GOVERNED BY THE 

  17. TERMS AND CONDITIONS OF THIS AGREEMENT AND/OR THE TERMS AND

  18.    CONDITIONS OF LICENSE AGREEMENTS OR NOTICES INDICATED OR REFERENCED 

  19. BELOW.  BY USING THE CONTENT, YOU AGREE THAT YOUR USE

  20.    OF THE CONTENT IS GOVERNED BY THIS AGREEMENT AND/OR THE TERMS AND 

  21. CONDITIONS OF ANY APPLICABLE LICENSE AGREEMENTS OR

  27. <h3>Applicable Licenses</h3>

  29. <p>Unless otherwise indicated, all Content made available by the Eclipse

  30.  Foundation is provided to you under the terms and conditions of the 

  31. Eclipse Public License Version 1.0

  32.    ("EPL").  A copy of the EPL is provided with this Content and is also

  33.  available at <a href="http://www.eclipse.org/legal/epl-v10.html">http://www.eclipse.org/legal/epl-v10.html</a>.

  34.    For purposes of the EPL, "Program" will mean the Content.</p>

  36. <p>Content includes, but is not limited to, source code, object code, 

  37. documentation and other files maintained in the Eclipse Foundation 

  38. source code

  39.    repository ("Repository") in software modules ("Modules") and made 

  40. available as downloadable archives ("Downloads").</p>

  43.        <li>Content may be structured and packaged into modules to 

  44. facilitate delivering, extending, and upgrading the Content.  Typical 

  45. modules may include plug-ins ("Plug-ins"), plug-in fragments 

  46. ("Fragments"), and features ("Features").</li>

  47.        <li>Each Plug-in or Fragment may be packaged as a sub-directory 

  48. or JAR (Java&#8482; ARchive) in a directory named "plugins".</li>

  49.        <li>A Feature is a bundle of one or more Plug-ins and/or 

  50. Fragments and associated material.  Each Feature may be packaged as a 

  51. sub-directory in a directory named "features".  Within a Feature, files 

  52. named "feature.xml" may contain a list of the names and version numbers 

  53. of the Plug-ins

  54.       and/or Fragments associated with that Feature.</li>

  55.        <li>Features may also include other Features ("Included 

  56. Features"). Within a Feature, files named "feature.xml" may contain a 

  57. list of the names and version numbers of Included Features.</li>

  60. <p>The terms and conditions governing Plug-ins and Fragments should be 

  61. contained in files named "about.html" ("Abouts"). The terms and 

  62. conditions governing Features and

  63. Included Features should be contained in files named "license.html" 

  64. ("Feature Licenses").  Abouts and Feature Licenses may be located in any

  65.  directory of a Download or Module

  66. including, but not limited to the following locations:</p>

  67. 

  68. <ul>

  69.        <li>The top-level (root) directory</li>

  70.        <li>Plug-in and Fragment directories</li>

  71.        <li>Inside Plug-ins and Fragments packaged as JARs</li>

  72.        <li>Sub-directories of the directory named "src" of certain 

  73. Plug-ins</li>

  74.        <li>Feature directories</li>

  77. <p>Note: if a Feature made available by the Eclipse Foundation is 

  78. installed using the Provisioning Technology (as defined below), you must

  79.  agree to a license ("Feature Update License") during the

  80. installation process.  If the Feature contains Included Features, the 

  81. Feature Update License should either provide you with the terms and 

  82. conditions governing the Included Features or

  83. inform you where you can locate them.  Feature Update Licenses may be 

  84. found in the "license" property of files named "feature.properties" 

  85. found within a Feature.

  86. Such Abouts, Feature Licenses, and Feature Update Licenses contain the 

  87. terms and conditions (or references to such terms and conditions) that 

  88. govern your use of the associated Content in

  89. that directory.</p>

  90. 

  91. <p>THE ABOUTS, FEATURE LICENSES, AND FEATURE UPDATE LICENSES MAY REFER 

  92. TO THE EPL OR OTHER LICENSE AGREEMENTS, NOTICES OR TERMS AND CONDITIONS.

  116. <h3>Use of Provisioning Technology</h3>

  117. 

  118. <p>The Eclipse Foundation makes available provisioning software, 

  119. examples of which include, but are not limited to, p2 and the Eclipse

  120.    Update Manager ("Provisioning Technology") for the purpose of 

  121. allowing users to install software, documentation, information and/or

  122.    other materials (collectively "Installable Software"). This 

  123. capability is provided with the intent of allowing such users to

  124.    install, extend and update Eclipse-based products. Information about 

  125. packaging Installable Software is available at <a 

  126. href="http://eclipse.org/equinox/p2/repository_packaging.html">http://eclipse.org/equinox/p2/repository_packaging.html</a>

  127.    ("Specification").</p>

  128. 

  129. <p>You may use Provisioning Technology to allow other parties to install

  130.  Installable Software. You shall be responsible for enabling the

  131.    applicable license agreements relating to the Installable Software to

  132.  be presented to, and accepted by, the users of the Provisioning 

  133. Technology

  134.    in accordance with the Specification. By using Provisioning 

  135. Technology in such a manner and making it available in accordance with 

  136. the

  137.    Specification, you further acknowledge your agreement to, and the 

  138. acquisition of all necessary rights to permit the following:</p>

  139. 

  140. <ol>

  141.        <li>A series of actions may occur ("Provisioning Process") in 

  142. which a user may execute the Provisioning Technology

  143.        on a machine ("Target Machine") with the intent of installing, 

  144. extending or updating the functionality of an Eclipse-based

  145.        product.</li>

  146.        <li>During the Provisioning Process, the Provisioning Technology 

  147. may cause third party Installable Software or a portion thereof to be

  148.        accessed and copied to the Target Machine.</li>

  149.        <li>Pursuant to the Specification, you will provide to the user 

  150. the terms and conditions that govern the use of the Installable

  151.        Software ("Installable Software Agreement") and such Installable 

  152. Software Agreement shall be accessed from the Target

  153.        Machine in accordance with the Specification. Such Installable 

  154. Software Agreement must inform the user of the terms and conditions that

  155.  govern

  156.        the Installable Software and must solicit acceptance by the end 

  157. user in the manner prescribed in such Installable Software Agreement. 

  158. Upon such

  159.        indication of agreement by the user, the provisioning Technology 

  160. will complete installation of the Installable Software.</li>

  161. </ol>

  162. 

  163. <h3>Cryptography</h3>

  164. 

  165. <p>Content may contain encryption software. The country in which you are

  166.  currently may have restrictions on the import, possession, and use, 

  167. and/or re-export to

  168.    another country, of encryption software. BEFORE using any encryption 

  169. software, please check the country's laws, regulations and policies 

  170. concerning the import,

  171.    possession, or use, and re-export of encryption software, to see if 

  172. this is permitted.</p>
